General Terms and Conditions for the Sale of Goods
1. Introduction
These terms and conditions (the ‘Terms and Conditions’) shall apply to and govern all Orders between Sacred Retreat Ltd, as the seller (‘Sacred Retreat’ or ‘us/we’) and you as the buyer (‘the Buyer’ or ‘you’) and shall apply together with our Website Terms of Service to each contract for the sale and supply (the ‘Order’) of Goods (the ‘Goods’)

Important: Approved Trade/Wholesale Stockists
(i) Payment for trade orders is required before dispatch of goods. Payment is to be made via Worldpay.
(ii) Goods will be dispatched according to postage selected.
(iii) Trade Stockists are only permitted to include Sacred Retreat products as part of their retail sales offering –
they are not permitted to include our products as part of their trade/wholsesale offering.
(iv) Trade Stockists are permitted to advertise Sacred Retreat products on their business web site.
(v) The CD images cannot be used in any other form of advertising (other than on your business web site) without the prior written permission of the Sacred Retreat team.
(vi) Trade Stockists are not permitted to list Sacred Retreat products on any of Amazon’s sites worldwide (e.g. www.amazon.co.uk or www.amazon.com).
Your attention is also drawn to the following provisions: Clause 6 (Warranty and Liability) and Clause 7 (Risk).
No variation in any documents from the Buyer purporting to vary these terms and conditions shall be effective unless expressly agreed in writing by us.
2. Prices
(i) All prices for Goods (the ‘Price’) are set out in our catalogue and on our website and are in £UK; and for UK buyers will be subject to Value Added Tax at the rate prevailing at the time of despatch.
(ii) Whilst every endeavour will be made to maintain our prices we reserve the right to alter prices at any time without notice.
(iii) A VAT invoice will be issued to you via the email link that you have provided upon registration.
3. Delivery & Acceptance
(i) Any delivery date given by us to the Buyer shall be an estimated date only and while we will always endeavour to comply with any such date we shall not be responsible for late delivery and without prejudice to the generality of the foregoing we shall not be liable for late delivery or failure to deliver through any cause which is beyond our reasonable control. Without limiting the foregoing the following shall be regarded as examples of causes beyond our reasonable control:
(a) Strikes, lock-outs or other industrial actions or trade disputes involving employees of a third party;
(b) difficulties in obtaining products from third parties, delays in carriage and distribution by third parties.
(ii) Any complaint by the Buyer of short or non-delivery or damage to the Goods shall be notified in writing to us in seven days upon receipt of the Goods by e-mail info@sacredretreat.com or by telephone no. 08456 808068.
4. Payment
Payment is due upon the Order being placed and will be effected by payment card or alternatively by Worldpay.
5. Cancellation
The Buyer may cancel the Order at any time prior to despatch by contacting us by telephone on 08456 808068 or by e-mail info@sacredretreat.com marking your e-mail ‘Urgent’. If the Order has already been despatched the Buyer must return it to us in a saleable condition complete in its original packaging to the address below. We will refund the Buyer by whichever method the Buyer utilised to place the Order.

6. Warranties and Liability
(i) Subject to the following provisions we warrant that the Goods will correspond with their specification at the time of delivery and will be free from defects in material and workmanship upon delivery.
(ii) Subject as expressly provided in these Terms & Conditions, all warranties, conditions or other terms implied by statute or common law excluded to the fullest extent permitted by law.
(iii) Where a valid claim in respect of any of the Goods which is based on a defect in the quality or condition of the Goods or their failure to meet specification is notified to us in accordance with these Terms & Conditions we may replace the Goods (or the part in question) free of charge, or at our sole discretion, refund to the Buyer the price of the Goods or (or a proportionate part of the price), in which case we shall have no further liability to the Buyer.
(iv) Except in respect of death or personal injury caused by our negligence or liability for defective products under the Consumer Protection Act 1987, we shall not be liable to the Buyer by reason of any representation (unless fraudulent) or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Order, for loss of profit or any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of us, our employees or agents or otherwise) which arise out of or in connection with the supply of the Goods (including any delay in supplying or any failure to supply the Goods in accordance with the Order or at all) or their use or resale by the Buyer, and the entire liability under or in connection with the Order shall not exceed the Price of the Goods, except as expressly provided in these Terms & Conditions.
7. Risk
All Goods are borne at Buyer's risk from the time notification when delivery, or attempted delivery, takes place at the address stipulated in the Order.
8. Law
These conditions and all other terms of the Order shall constitute the entire understanding and agreement between us and the Buyer. These Terms and Conditions are governed by and are to be construed in accordance with English Law and fall within the exclusive jurisdiction of the English Courts.
